The 14 MOTION to Dismiss filed by defendants KEITH GUTHRIE, MARY ANN PATTI LLC, MARY ANN PATTI GUTHRIE, is GRANTED. (5.) Said dismissals are without prejudice to the plaintiffs filing, within 28 days of this order, a seco nd amended complaint that corrects the legal deficiencies identified in the magistrate judge's Report and Recommendation of February 22, 2010. Failure to file a second amended complaint will result in the dismissal of this case. (6.) Having considered the report and recommendation and all objections thereto timely filed, I have determined that the report and recommendation should be adopted.
