Accordingly, it is now ORDERED as follows: 1. The magistrate judge’s Report and Recommendation is adopted and incorporated by reference in this order. 2. Defendants’ Motion and Memorandum in Support of Motion to Dismiss (doc. 4) is GRANTED. 3. This action is DISMISSED, pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure, for Plaintiff’s failure to state a claim upon which relief can be granted.
