Plaintiff was furnished a copy of the Report and Recommendation and afforded an opportunity to file objections pursuant to Title 28, United States Code, Section 636(b)(1). Plaintiff has filed a Motion for Leave to Proceed in forma pauperis (ECF Doc. 4). Otherwise, there have been no timely filed objections. Accordingly, it is now ORDERED as follows: (1) The Magistrate Judge’s Report and Recommendation (ECF Doc. 3) is adopted and incorporated by reference in this order. (2) The Plaintiff’s Motion to Proceed in forma pauperis (ECD Doc. 4) is deemed moot. (3) This case is DISMISSED WITHOUT PREJUDICE for lack of subjectmatter jurisdiction.
