ORDER
The magistrate judge issued two Report and Recommendations on October
17, 2023. (Docs. 69, 70). The Court furnished the parties copies of the Report and
Recommendations and afforded an opportunity to file objections pursuant to Title
28, United States Code, Section 636(b)(1). No objections have been filed.
Having considered the Report and Recommendations, I have determined it
should be adopted.
Accordingly, it is ORDERED:

The magistrate judge’s Report and Recommendations (Docs. 69, 70)

are adopted and incorporated by reference in this order.

Defendant May’s motion to dismiss, (Doc. 35), is DENIED.
