The court has reviewed the record and has determined that the magistrate judge's report and recommendation should be adopted. Accordingly, it is ORDERED: 1. The magistrate judge’s report and recommendation (doc. 45) is hereby ADOPTED and incorporated by reference in this order. 2. The motion to dismiss (doc. 19) filed by the United States Department of Justice, Bureau of Prisons, is GRANTED. 3. The United States Department of Justice, Bureau of Prisons, is hereby DISMISSED from this action. Page 2 of 2 4. The motion for summary judgment (doc. 17) filed by the United States Department of Justice is DENIED as moot. 5. The case is REMANDED to the magistrate judge for further proceedings.
