ORDER ACCEPTING AND ADOPTING 35 REPORT AND RECOMMENDATION - The Clerk shall enter judgment stating,"Plaintiff's second amended complaint, ECF No. 34 , is DISMISSED for failure to state a claim upon which relief may be granted pursuant to 28 U.S.C. § 1915(e)(2)(B)(ii), as malicious pursuant to 28 U.S.C. § 1915(e)(2)(B)(i) because Plaintiff has abused the judicial process." Upon consideration, IT IS ORDERED: The report and recommendation is accepted and adopted as this Court’s opinion over Plaintiff's objections. The Clerk shall enter judgment stating, "Plaintiff's second amended complaint, ECF No. 34, is DISMISSED for failure to state a claim upon which relief may be granted pursuant to 28 U.S.C. § 1915(e)(2)(B)(ii), as malicious pursuant to 28 U.S.C. § 1915(e)(2)(B)(i) because Plaintiff has abused the judicial process."
