ORDER
This matter is before the Court on consideration of the magistrate judge’s
Report and Recommendation dated July 1, 2021 (ECF No. 26). Plaintiff was
furnished with a copy of the Report and Recommendation and afforded an
opportunity to file objections pursuant to Title 28, United States Code, Section
636(b)(1). I have made a de novo determination of all timely filed objections. See
ECF No. 31.
Having considered the Report and Recommendation and any duly filed
objections, I have determined that the Report and Recommendation should be
adopted.
Accordingly, it is now ORDERED as follows:
(1) The Magistrate Judge’s Report and Recommendation (ECF Doc. 26), is
adopted and incorporated by reference in this order.

(2) The amended petition under 28 U.S.C. § 2254, challenging the conviction
