JOINT NOTICE OF SETTLEMENT OF CLAIMS AGAINST ARTHUR ANDERSEN LLP. MICHAEL S. MARX. AND P. ANTHONY NISSLEY
Plaintiffs Mark and Elyse Gainor ("Plaintiffs") and Defendants Arthur Andersen LLP,

Michael S. Mar, and P. Anthony Nissley (the "Andersen Defendants") respectfully submit this
Notice of Settlement, and inform the Court as follows:
1. Plaintiffs Mark and Elyse Gainor have reached an agreement with the Andersen

Defendants to resolve the claims against these defendants.
2. The paries are in the process of finalizing a confidential settlement agreement

and wil be fiing a Notice of Dismissal with the Court shortly.

3. Accordingly, the Andersen Defendants wil not be filing replies in support of

their

Motions to Dismiss fied on July 11,2007, or responses to the Plaintiffs' Motions to Compel fied on July 11, 2007, and there is no need for the Court to further consider or rule on any of
these motions.
