Marx, and P. Anthony Nissley (D.E. No. 171), which was filed on September 5, 2007. It is: ADJUDGED that this action is DISMISSED with prejudice. Each party shall bear its own attorney's fees and costs. However, the Court shall retain jurisdiction to enforce the terms of the parties' settlement agreement if necessary. It is also: ADJUDGED that all pending motions in this case are DENIED AS MOOT, and this case is CLOSED with respect to Plaintiffs' claims against Defendants Arthur Andersen, LLP, Michael S. Marx, and P. Anthony Nissley. Plaintiffs' Claims against the remaining Defendants are not affected by this action. DONE AND ORDERED in Chambers at Miami, Florida, September 5, 2007.
