Plaintiffs seek a stay of discovery as to all but one of the Defendants, until November 14, 2008, on the anticipation that the district court in the In re: Pet Food Products Liability Litigation case pending in the District of New Jersey will have granted or denied final approval of a class settlement in that action. With neither final approval a certainty on the date suggested by Plaintiffs, nor that Plaintiffs' objections to the form of settlement, if any, will be fully resolved by the date selected, the requested stay in this case is not appropriate. Accordingly, it is ORDERED AND ADJUDGED that the Motion to Stay [D.E. 421] is DENIED without prejudice, and the associated request for oral argument [D.E. 422] is similarly DENIED. Plaintiffs are invited to confer with all parties concerning a stay of this case in its entirety until such time as final approval and any appellate proceedings related thereto of the settlement in the New Jersey action are concluded.
