PLAINTIFF'S NOTICE TO COURT COMES NOW plaintiff Thompson, as an attorney on his own behalf, and provides notice to this court, stating: 1. At the start of the business day on Thursday, September 6, defendant referee Tunis had in her possession a subpoena for the September 17 taking of the deposition, duce tecum, of Al Cardenas, who filed one of the SLAPP Bar complaints against Thompson. The time and date had been agreed to by all the parties. Thompson gave it to her. 2. Now, five days later, the undersigned has no executed subpoena, by referee Tunis, despite her promise that executed subpoenas would be executed the same day. 3. In the state proceedings defendant/referee/Judge Tunis continues to thwart all meaningful discovery by Thompson, refuses to schedule hearings, refuses to adhere to United States Supreme Court decisions, and generally, all on her own, continues to underscore, by her behavior, the need for a preliminary injunction to be entered herein.
