PLAINTIFF'S NOTICE TO COURT COMES NOW plaintiff, John B. Thompson, hereinafter Thompson, as an attorney on his own behalf, and provides notice to the court as follows: Should this court be tempted to wonder why Thompson has given up, at least temporarily, trying to squeeze water from the state's disciplinary sand, it should take a look at the attached August 7 letter from The Bar's "Ethics Division Director," Ms. Bateman. Ms. Bateman informs Thompson that he can see his own records for the piffling fee of a mere $4000. Thompson is a party, entitled to see them free of charge, but Referee Tunis, who is apparently unfamiliar with the fact that a party is entitled to see such documents, will not order their production without Thompson's ponying up the $4000. Further, and this is possibly even worse, Ms. Bateman informs Thompson in this letter that The Bar is unilaterally going to decide what he gets to see, and "remove" and "redact" documents as it deems appropriate without making any "Privilege Log" by Case No. 07-21256 (Judge Adalberto Jordan) 1 Dockets.Justia.com which to alert Thompson what has been removed and redacted so that he can litigate, fairly, the appropriateness of such removals and redactions. Apparently Judge Tunis is unfamiliar with the concept of a "Privilege Log" as well, as she has given The Bar the green light to redact and remove documents at will. Thompson, having once represented Lt. Col. Oliver North, can get The Bar a document shredder, cheap. WHEREFORE, Thompson simply wants this Honorable Court to know that The Bar's idea of "litigation," as the Bateman letter proves, is to charge him for what he has a right to see for free and to decide, unilaterally, with no judicial review, what he gets to see.
