PLAINTIFF'S MOTION FOR ORDER TO SHOW CAUSE COMES NOW plaintiff, John B. Thompson, hereinafter Thompson, as an attorney on his own behalf, and hereby moves the court for the entry of an order to show cause, stating: The Florida Bar's record counsel herein, Ms. Sharpe and Mr. Richard, both of Greenberg Traurig, have cited to this court the case of Mason v. Florida Bar. This case, which is a federal court ruling out of the Middle District of Florida, has been cited to this court for the proposition that this court must abstain from interfering in any fashion with a state disciplinary proceeding, even when the bar respondent has tried to raise constitutional issues, because under Mason, a bar respondent has a right to argue his constitutional defenses directly to The Florida Bar's Board of Governors, before any disciplinary trial. These two lawyers are knowingly misrepresenting facts and law to this court. Thompson has been denied, at least ten times, his right, made by written request, to address the Bar Governors, prior to his disciplinary trial, regarding constitutional issues. Case No. 07-21256 (Judge Adalberto Jordan) 1 Dockets.Justia.com Ms. Sharpe knows it. Mr. Richard knows it. Their misrepresentations to this court are knowing, consequential, and unethical. WHEREFORE, Thompson moves this court for the entry of a show cause order asking these two attorneys to explain why this court, because of this unethical conduct, should not refer them to the Ad Hoc Committee dealing with such matters. This court is very keen about using that Ad Hoc Committee to keep evidence of The Bar's wrongdoing out of the court file. It is time this court used the Committee to deal with real unethical conduct by The Bar's record counsel.
