THOMPSON ) ) Plaintiff ) vs. ) ) THE FLORIDA BAR, et al ) Defendants ) ____________________________________ ) ORDER Judge Tunis has filed an emergency motion to strike Mr. Thompson's notice of her deposition. Since the parties have not conferred as required by Rule 26(f), the court believes that Mr. Thompson's request to take discovery is premature. See Fed.R.Civ.P. 26(d) (a litigant "may not seek discovery from any source before the parties have conferred as required by Rule 26(f)" without an order from the court or the agreement of the parties). Accordingly, by noon on Thursday, August 2, 2007, Mr. Thompson shall file a response to Judge Tunis' emergency motion, explaining why he believes he can proceed with discovery notwithstanding the clear prohibition in Rule 26(d). A courtesy copy of his response must also be delivered directly to my chambers by noon on Thursday. If Mr. Thompson's response is not received by such deadline, Judge Tunis' motion will be granted.
