PLAINTIFF'S RESPONSE TO AUGUST 1 ORDER RE DEPOSITION OF JUDGE TUNIS COMES NOW plaintiff, John B. Thompson, hereinafter Thompson, as an attorney on his own behalf, and responds to the above-noted order, stating: 1. Plaintiff informed counsel for Judge Tunis, yesterday, via e-mail, of his Case No. 07-21256 (Judge Adalberto Jordan) agreement to stay discovery, including the deposition of Judge Tunis, in light of The Bar's and her concerns in that regard. Late yesterday plaintiff also filed a pleading with the court which he believes indicates clearly that he has agreed not to proceed with discovery, which informs defendants of that. Why counsel for Judge Tunis did not inform the court of this twice-conveyed acceding of plaintiff to his demand is unknown to plaintiff. 2. Plaintiff will hand-deliver a copy of this filing to the court by tomorrow if that is necessary, although he hopes and requests that this reiteration of the agreement with and among the parties in this regard, filed electronically with the court, will be sufficient. He awaits word from the court in that regard. 3. Plaintiff reiterates and underscores his request for a status conference so that the court and the parties might see where we are all headed in this litigation. The Bar has 1 Dockets.Justia.com set an unrealistic and unfair disciplinary trial date for early September, so what we have now is an emergency. The defendants want and will allow no discovery even in that action, and yet they have set a trial nevertheless. This is violative of due process guarantees of the U.S. Constitution, which is why this action has been filed. See Pulliam v. Allen.
