The Florida Bar Doc. 376 Immediate News Release ­ Dec. 15, 2007 Florida Bar Declares War on the First Amendment; Florida Lawyer Declares War on Florida Bar The Florida Bar is seeking to disbar two lawyers who have, independent of one another, criticized three judges who have acted improperly and abused their judicial offices. A Broward County lawyer, Sean Conway, has been charged by the Florida Bar with acting "unethically" for posting at a popular legal community blog truthful statements about the excesses of Broward Judge Cheryl Aleman. The state's Judicial Qualifications Commission has just finished a trial of Aleman, charging her with the very same things that attorney Conway asserted at the blog! See http://blogs.wsj.com/law/2007/12/14/should-lawyer-be-disbarred-for-harsh-criticism-ofa-judge/ The Florida Bar is also seeking to disbar Miami attorney and nationally-known anti-video game activist Jack Thompson for his truthful exposure of the antics of an Alabama judge who presides over a wrongful death case Thompson has brought against the video game industry. The case was featured on CBS' 60 Minutes. Thompson also criticized a Miami-Dade Circuit Court judge, Ron Friedman, who announced his decision in another video game case brought by Thompson before the trial in the case, and then Friedman brought a bar complaint against Thompson after Thompson properly brought a motion to disqualify the judge because of his unethical, premature ruling. Florida's Third District Court of Appeal recently slammed Friedman for doing the same thing in another case to another litigant! Thus, the Florida Bar's position is that anyone other than a lawyer can criticize incompetent, corrupt, or misbehaving judges, but lawyers have given up their First Amendment rights. Nonsense. Recently a federal judge in Michigan ruled that noted lawyer Geoffrey Fieger could harshly criticize the Michigan Supreme Court, as such speech is protected by the First Amendment. See http://pub.bna.com/lw/0611684.pdf. What we are seeing in Florida is the wisdom of Supreme Court Justice Hugo Black's prediction in Lathrop v. Donohue that integrated state bars would eventually become "goose-stepping brigades." What makes the Florida Bar's fascism all the more remarkable is that one of its Florida Bar Governors guiding this assault upon the First Amendment is Ben Kuehne. Kuehne has been served with a U.S. Department of Justice "target letter" for allegedly laundering Medellin cocaine cartel money. The Bar considers this ACLU, leftwing ideologue an untouchable, yet it seeks to disbar two lawyers who have truthfully indentified judicial corruption. Therefore, Miami attorney Jack Thompson today announces a multi-faceted effort to tear down the wall The Florida Bar has erected between the First Amendment and judicial corruption and tyranny. Thompson recently drafted and secured unanimous passage of his bill in Louisiana, which was then signed into law. Thompson thus knows how to get Dockets.Justia.com legislation passed and will get passed in Florida legislation necessary to stop this reign of terror by the Bar. Thompson has also appeared on hundreds of national and international television programs over the past decade. He will now seek, through the media, to join those who have identified the judicial tyranny that increasingly threatens the freedoms of all of us.
