Thompson v. The Florida Bar Doc. 41 IN THE UNITED STATES DISTRICT COURT FOR THE SOUTHERN DISTRICT OF FLORIDA JOHN B. THOMPSON, Plaintiff, v. THE FLORIDA BAR and DAVA J. TUNIS, Defendants. Case No. 07-21256 (Judge Adalberto Jordan) NOTICE TO COURT COMES NOW plaintiff, John B. Thompson, hereinafter Thompson, as an attorney on his own behalf, and provides notice to this court as follows: 1. Court's law clerk kindly contacted the parties yesterday and indicated that the court was intending to convene a hearing on plaintiff's motion for preliminary injunction. She wanted to know when the trial of Thompson in the "disciplinary" matter would be, and Thompson said the first week of September. This was asked so that the court would know when to have the hearing before the trial. 2. The court's clerk kindly called plaintiff back and informed him that counsel for the parties said they did not know when the trial was to be. 3. The Bar has today moved the referee for a continuance of the trial, possibly to November. Plaintiff does not know if the referee will continue the matter and if so until when. Plaintiff has asked the referee to stay the proceedings, in light of The Bar's motion, until this federal court addresses the preliminary injunction. 4. Thus, the purpose of this notice is to follow up on this court's clerk kind inquiry with the above information. 1 Dockets.Justia.com 5. Plaintiff respectfully suggests that now would be a good time for the parties to mediate this matter, and plaintiff reiterates his desire that the court enter an order to that effect. I HEREBY CERTIFY that this has been served upon record counsel this 10th day of August, 2007, electronically. /s/ JOHN B.
