NON-PARTIES’ NOTICE OF COMPLIANCE WITH COURT ORDER [D.E. 301]
Pursuant to the Court’s Endorsed, Paperless Order [D.E. 301] requiring timely notice to
the Court concerning the need for a hearing on September 23, 2011, Non-Parties, Verizon
Wireless Personal Communications LP d/b/a Verizon Wireless (“Verizon Wireless”) and Alltel
Communications LLC d/b/a Alltel Wireless (“Alltel Wireless”), hereby notify the Court that,
after extensive discussions with Counsel for the Defendants, including a conference call with
Counsel for Plaintiffs, Verizon Wireless, Alltel Wireless and Defendants have resolved their
dispute concerning the six subpoenas duces tecum for deposition that were transmitted by
facsimile on September 8, 2011. Defendants have withdrawn the two subpoenas returnable on
September 26, 2011 and have withdrawn the remaining subpoenas except to the extent that they
seek only the production of five limited categories of documents, and Verizon Wireless and
Alltel Wireless will have 15 days within which to prepare its responses to the narrowed requests.
Accordingly, Verizon Wireless and Alltel Wireless will not re-file their Motion to Quash the
subpoenas and a hearing will not be necessary on September 23, 2011.
