NOTICE OF SETTLEMENT COMES NOW, Plaintiff, David Kardonick, by and through his attorneys and for his Notice of Settlement states as follows: 1. 2. Plaintiff commenced this action (the "Action") on September 8, 2010. Recently, Plaintiff and Defendants have been engaged in settlement negotiations to resolve Plaintiff's claims as part of a global settlement of all claims alleged against Defendants JP Morgan Chase & Co. ("JPMorgan") and Chase Bank USA, N.A. (collectively "Chase" or "Defendants"). 3. In this regard, the parties have executed a Memorandum of Settlement and are currently in the process of memorializing the terms and conditions of the global settlement in a detailed Settlement Agreement. 4. The global settlement, once finalized, will resolve all of the class claims pending before this Court, subject to court approval.
