PLAINTIFFS' REQUEST FOR HEARING ON JOINT MOTION FOR PRELIMINARY APPROVAL OF SETTLEMENT, CONDITIONAL CERTIFICATION OF THE SETTLEMENT CLASS, APPROVAL OF NOTICE PLAN AND SETTING OF FAIRNESS HEARING Pursuant to Local Rule 7.1B, Plaintiffs David Kardonick, John David and Michael Clemins request a hearing on the Joint Motion for Preliminary Approval of Settlement, Conditional Certification of the Settlement Class, Approval of Notice Plan, and Setting of Fairness Hearing. A hearing will assist the Court in its consideration of the issues raised by the motion, and will permit the scheduling of notice dates and the date of the fairness hearing. Plaintiffs estimate 20 minutes will be sufficient.
