APPLE INC.’S OPPOSITION TO MOTOROLA MOBILITY, INC.’S REQUEST FOR ORAL ARGUMENT ON APPLE’S MOTION TO STRIKE MOTOROLA’S SUPPLEMENTAL INFRINGEMENT CONTENTIONS Defendant Apple Inc. ("Apple") hereby opposes Motorola's request for oral argument on Apple's motion to strike Motorola's supplemental infringement contentions (D.E. 178). As Motorola recognizes in its request (a request made after its opposition and therefore not in compliance with Local Rule 7.1(b)(2)), there have already been several briefs filed on the issues raised in Apple's motion, with a final reply brief to be filed by Apple on December 5, such that the Court will be well apprised of all of the parties' arguments without any need for a hearing. Motorola gives no indication of any additional information it expects to be conveyed to the Court during a hearing on the motion. Motorola states that oral argument will help to narrow the issues presented by the parties, but given that there is only one main issue presented -whether Motorola should be allowed to supplement its infringement contentions five months after the Court's deadline -- Motorola fails to show how a hearing would serve any narrowing purpose. Furthermore, the parties already presented oral arguments to the Court on the issues raised in Apple's motion during the claim construction hearing on October 19, 2011, also obviating the need for an additional hearing.
