MOTOROLA MOBILITY’S UNOPPOSED REQUEST FOR ORAL ARGUMENT ON
APPLE INC.’S MOTION FOR LEAVE TO FILE AMENDED ANSWER

Case No. 1:10cv023580-Civ-RNS-TEB
Plaintiff Motorola Mobility, Inc. (“Motorola”) requests oral argument on defendant
Apple, Inc.’s motion for leave to file amended answer (D.E. 278, 279).
The issues raised in Apple's motion, and Motorola's opposition, are significant. Apple’s
motion contradicts its earlier insistence that the parties could not update their infringement
contentions now that the scheduled date for infringement contentions passed. Accordingly,
Motorola requests that both parties be able to supplement their infringement contentions at this
point or, in the alternative, that Apple be denied leave to file its amended answer.
Given the significance of the issue, Motorola respectfully suggests that oral argument
would be of assistance to the Court. Furthermore, oral argument may assist the Court with the
procedural history of the case.
Motorola estimates that the oral argument would last no longer than thirty minutes.
Motorola respectfully suggests that, given out-of-town counsel, the hearing could be held
telephonically if the Court believes appropriate.
Apple has informed Motorola that it does not oppose this Request for oral argument.
