PLAINTIFF’S NOTICE OF FILING CORRECT EXHIBIT D
IN SUPPORT OF SECOND AMENDED COMPLAINT
Plaintiff, by and through the undersigned counsel, files this notice of filing the correct
Exhibit D of the Second Amended Complaint, and in support thereof states:
1.

On January 13, 2014, Plaintiff filed with the leave of the court, his Second

Amended Complaint, with Exhibits labeled A – V [DE 24].
2.

After filing the Complaint, it came to Plaintiff’s attention, that there was an error

with the filed Exhibit D, the Affidavit of Yunior Despaigne. The copy of the exhibit filed with
the Second Amended Complaint was a draft copy of the affidavit, which contained information
that had been corrected in the final draft.
3.

Attached to this Notice as “Exhibit A” is the final copy of Yunior Despaigne’s

affidavit, which corresponds to Exhibit D in the Second Amended Complaint..
