REED ELSEVIER, INC., SEISINT, INC., CITIBANK, FEDERAL SAVINGS BANK, CITIBANK (WEST), FSB, CITIMORTGAGE, INC., and TRANS UNION, LLC, Defendants. ____________________________________/ ORDER This Cause comes before the Court on Plaintiff's Agreed Motion for Extension of Time to File Joint Pretrial Stipulation (DE 48). The Court has reviewed the record and is fully advised in the premises. In this case, Plaintiff Michael Young ("Young") brings a claim against Defendant Trans Union LLC ("Trans Union") under the Fair Credit Reporting Act ("FCRA") 15 U.S.C. § 1681, et seq. Trial is set for the two-week trial calendar period beginning October 15, 2007, with the Calendar Call scheduled for October 10, 2007 (DE 13). All Defendants have been terminated in this litigation, except Defendant TRANS UNION LLC. The deadline to file the pretrial stipulation was September 17, 2007. The Federal Rules of Civil Procedure provide that "[w]hen . . . an act is required or allowed to be done at or within a specified time, the court for cause shown may at any time in its 1 Dockets.Justia.com Case 9:07-cv-80031-DMM Document 50 Entered on FLSD Docket 09/20/2007 Page 2 of 2 discretion . . . order the period enlarged if request therefor is made before the expiration of the period originally prescribed . . . ." Fed. R. Civ. P. 6(b). Plaintiff states that the parties have reached a settlement agreement and a stipulation for dismissal of TRANS UNION LLC is expected to be filed within the next ten (10) days. The parties wish to reduce fees and expenses to their clients since a settlement has been reached. While extensions of time are generally disfavored, Plaintiff has shown good cause for this extension of time. Accordingly, it is ORDERED AND ADJUDGED that Plaintiff's Agreed Motion for Extension of Time to File Joint Pretrial Stipulation (DE 48) is GRANTED. The Court expects the parties to file either a stipulation of dismissal of the case or the Joint Pretrial Stipulation by September 27, 2007.
