JUDGMENT ON DEFENDANT'S MOTION FOR AN AWARD OF COSTS This cause is before the Court upon the Report and Recommendation of the Magistrate Judge, filed May 14, 2009 (DE 56). The Court has reviewed the record de novo, considering Defendant's Verified Motion for Award of Attorney's Fees and Costs (DE 46, 47), filed September 12, 2008, the Report and Recommendation of the Magistrate Judge, and the entire file. Noting that no objections have been filed, for the reasons stated in the Report and Recommendation and upon independent review, it is ORDERED AND ADJUDGED as follows: 1. 2.
