P re v i o us l y , AllianceOne and Tucker filed a Rule 41 motion to drop A l l i a nc e O ne from the case (Doc. 12). The Court found that the motion was i nc o rre c tl y filed as a Rule 41 motion and ordered the parties to submit a joint Rule 2 1 motion (Doc. 13). To comply with the Court's order, AllianceOne and Tucker filed a Rule 21 m o ti o n, but Defendant HSBC Bank USA N.A. did not sign the motion. W i tho ut H S B C Bank's signature on the motion, the Court cannot drop AllianceOne from the c a s e . The Court is concerned that HSBC Bank would be potentially prejudiced by d i s m i s s a l of AllianceOne.
