Minute Entry for proceedings held before Judge Thomas W. Thrash, Jr:
Pretrial Conference, Motion Hearing held on 3/2812011 denying 180
MOTION for Protective Orderfor Depositions of Tyler Downey, Mark
Samansky and Christopher Helton filed by Maureen Toffoloni. The
Court advised counsel that he would bifurcate the trial: Phase 1 will
determine the amount ofcompensatory damages and if punitive
damages are to be awarded. Phase 2 will determine the amount of
punitive damages (if determination that any are due) and if attorney
fees and expenses, if any should be awarded. The Court then advised
counsel of the voir dire procedure that will be followed. 12 Jurors will
be selected. After jurors have answered the court's questions, if counsel
have any follow up as to a particular Juror that question should be
written down and handed to Ms. Sewell for the Court's consideration.
The Court will conduct the voir dire based on the questions submitted
by counsel. The question(s) regarding certain reading materials will be
given to the jurors in written form for a written response and
distribution to counsel, again any follow up question should be
I
submitted in written form and given to Ms. Sewell for the Court's
I
consideration. Counsel to confer in an attempt to agree on the questions I
and submit no later than April 11, 2011. If counsel are unable to agree ,
separate proposed questions may be submitted by that same date. The !
Court inquired about named defendant Mark Samansky, plaintiffs
counsel advised that this defendant had been in Bankruptcy at the
beginning of thecase, and the Bankruptcy had been terminated. The
Court DISMISSED Mark Samansky. The Court will allow each side 7
112 hours for presentation of their case, this included both phases and
