ORDER that the Plaintiffs are DIRECTED TO FILE, within 10 days of the entry of this Order, the following information: (1) The retail cost of each work identified per number 3 of the 226 Order at the time that work was allegedly infringed and (2) the cost of licensing the excerpts of those works that Plaintiffs allege were electronically distributed to Georgia State University students, per number 6 of the 226 Order. Plaintiffs must include a verification swearing that the information filed is true and accurate. Defendants may object to the materials filed within 10 days of filing. ORDER The Court DIRECTS Plaintiffs to file, within ten (10) days of
the entry of this Order, the following information : 1 . The retail cost of each work identified pursuant to number 3 of this Court's August 11, 2010 Order, at the time that work was a ll egedly infringed . In other words, what a student would have had to pay to purchase the entire work at the time that it was allegedly infringed ; and 2 . The cost of licensing the excerpts of those works that Plaintiffs allege were electronically distributed to Georgia State University students, identified pursuant to number 6 of this Court's August 11 Order . In other words, the total
amount that each instructor, identified pursuant to number 2 of this Court's August 11 Order, would have had to pay in order to license each excerpt for distribution in the course identified pursuant to number 1 of this Court's August 11 Order . If the cost is a function of the anticipated number
of users of the excerpt, assume a class size of twenty students and also state the fee per student . Plaintiffs must include a verification swearing that the
information filed is true and accurate . Defendants may object to
the material filed pursuant to this Order within ten (10) days after it is filed by Plaintiffs . SO ORDERED, this ~~ day of August, 2010 .
