FINAL REPORT AND RECOMMENDATION RECOMMENDING that Defendant's Motion to Dismiss 2 be GRANTED for Plaintiff's failure to state a claim. In addition, Defendant's Motion to Open Default 6 should be DENIED AS MOOT, and Plaintiff's Motion in Opposition to Defendant's Motion to Dismiss 4 should be DENIED. As this is a Final Report and Recommendation, there is nothing further in this action pending before the undersigned. Accordingly, the Clerk is DIRECTED to terminate t he reference of this matter to the undersigned.
