ORDER
This matter is before the Court for consideration of the Non-Final Report and
Recommendation of Magistrate Judge Walter E. Johnson [Doc. No. 18], to which no
objections have been filed. After reviewing the Report & Recommendation is
received with approval and ADOPTED as the Opinion and Order of this Court.
Accordingly, it is hereby ORDERED that Defendant’s Motion to Partially
Dismiss Count Three of the Complaint [Doc. No. 8] is DENIED.
