OPINION AND ORDER ADOPTING the Magistrate Judge's 7 Non-Final Report and Recommendations. The Defendants' 2 Motion to Dismiss for Failure to State a Claim is hereby GRANTED IN PART AND DENIED IN PART. All of Plaintiff's claims against Defendant Manboard are DISMISSED, and all of Plaintiff's claims against Defendant APS, except Plaintiff's ADEA claim, are also be DISMISSED.
