ORDER
After an independent and de nova review of the entire
record, the undersigned concurs with the Magistrate Judge's
Report and Recommendation, dkt. no. 9. Petitioner Christopher
McBee ("McBee") failed to file any Objections to the Magistrate
Judge's Report and Recommendation.
Accordingly, Respondent's Motion to Dismiss is GRANTED.
Dkt. No. 7. McBee's Petition for Writ of Habeas Corpus, filed
pursuant to 28 U.S.C. ยง 2241, is DISMISSED. The Clerk of Court
is DIRECTED to enter the appropriate judgment of dismissal and
to CLOSE this case. The Court DENIES McBee leave to proceed in
forma pauperis on appeal.
