ORDER
After a careful, de novo review of the file, the Court concurs with the Magistrate Judge's Report and Recommendation, to which objections have been filed (doe. no. 36).' Accordingly, the Report and Recommendation of the Magistrate Judge is ADOPTED as the opinion of the Court. Therefore, Defendants' Motion to Dismiss (doe. no. 17) is GRANTED IN PART and DENIED IN PART. Defendants Harman, Hobby, and Brown, as well as Plaintiffs claims concerning the incision and swelling in his right knee and the cancellation of his soft shoe profile, are DISMISSED. Plaintiffs request for monetary damages against Defendant Alston in her official capacity is DISMISSED. Additionally, Plaintiff's motions
