ORDER

After a careful, de novo review of the file, the Court concurs with the Magistrate
Judge's Report and Recommendation, to which no objections have been filed. Accordingly,
the Report and Recommendation of the Magistrate Judge is ADOPTED as the opinion of
the Court. Therefore, Defendants' motion for summary judgment (doe, no. 29) is
GRANTED IN PART and DENIED IN PART, and a FINAL JUDGMENT in this case
shall be entered in favor of Defendant Kemp only. Plaintiff's claim that Defendant Ricks
retaliated against him for filinggrie 'anee will proceed to trial.
