case. As a result, Plaintiff's complaint is DISMISSED WITHOUT
PREJUDICE and the Magistrate Judge's prior Report and
Recommendation (Doc. 11) is
DISMISSED AS MOOT
The Clerk of
Court is DIRECTED to close this case.
