ORDER ADOPTING the Magistrate Judge's 64 Report and Recommendation. The Court DISMISSES Plaintiff's claims without prejudice for failure to follow the Court's directives and failure to prosecute and DISMISSES as moot Defendants' ; 57 Motion to Dismiss. The Court DENIES Plaintiff leave to proceed in forma pauperis on appeal. The Court also DIRECTS the Clerk of Court to CLOSE this case and enter the appropriate judgment of dismissal. ORDER
After an independent and de novo review of the entire
record, the undersigned concurs with the Magistrate Judge's
Report and Recommendation,
(dkt. no. 64), to which Plaintiff
failed to file Objections.
Accordingly, the Court ADOPTS the
Magistrate Judge's Report and Recommendation as the opinion of
the Court.
The Court DISMISSES Plaintiff's claims without
prejudice for failure to follow the Court's directives and
failure to prosecute and DISMISSES as moot Defendants' Motion to
Dismiss,
(dkt. no. 57).
The Court DENIES Plaintiff leave to
proceed in forma pauperis on appeal.
