ORDER ADOPTING 9 Report and Recommendations of the Magistrate Judge as the opinion of the Court. The Court GRANTS Plaintiff's 8 Motion to Voluntarily Dismiss without prejudice claims against Defendant McGee. The Court further DISMISSES with prejudice Plaintiff's remaining allegations for failure to state a claim.
