Accordingly, the Report and Recommendation of the Magistrate Judge is adopted as the opinion of the Court. Plaintiffs action is DISMISSED WITHOUT PREJUDICE, and the Court DENIES Plaintiff leave to proceed informa pauperis on appeal.
