ORDER
After an independent and de novo review of the entire reeord, the undersigned concurs
with the Magistrate Judge's Report and Recommendation,(doe. 5), to which Plaintiff failed to
file Objections.
Accordingly, the Court ADOPTS the Magistrate Judge's Report and
Recommendation as the opinion of the Court. The Court DISMISSES without prejudice
Plaintiffs Complaint based on Plaintiffs failure to prosecute and failure to follow this Court's
Order and DIRECTS the Clerk of Court to CLOSE this ease and enter the appropriate judgment
of dismissal. The Court DENIES Plaintiff informa pauperis status on appeal.
