FINDINGS AND RECOMMENDATION
Findings and Recommendation having been filed and served on all parties
on November 23, 2011, and no objections having been filed by any party,
IT IS HEREBY ORDERED AND ADJUDGED that, pursuant to Title 28,
United States Code, Section 636(b)(1)(C) and Local Rule 74.2, the “Findings and
Recommendation That (1) Plaintiff’s Application to Proceed Without Prepayment
of Fees Be Granted; (2) Plaintiff’s ADEA Claim Be Dismissed with Prejudice; and
(3) Plaintiff’s Request for Appointment of Counsel Be Denied” are adopted as the
opinion and order of this Court.1
IT IS SO ORDERED.

The Court recommends that Plaintiff continue to seek counsel to represent him in this
matter. To assist Plaintiff in obtaining an attorney, the Court has attached to this Order a list of
