BARBARA D. UNDERWOOD hereby declares that:
I am an attorney licensed to practice in New York and I have been
granted admission to this Court pro hac vice, on July 5, 2017 (ECF No. 309).
I am the Solicitor General of the State of New York. This Declaration
is submitted in support of the State of New York’s Motion for Leave to File a MultiState Amicus Brief, filed concurrently herewith.
As New York Solicitor General, I have access to records and files kept
in the normal course of the business conducted by the Office of the Attorney General
of New York. Attached hereto as Exhibit “1” is a true and accurate copy of the amici
States’ proposed amicus brief.
It is my understanding, based on conversations between counsel in this
matter, that plaintiffs consent to the filing of the amicus brief and defendants oppose
the motion for leave to file on the ground that plaintiffs’ reply submissions have been
filed (ECF No. 303) and thus, in defendants’ view, briefing is closed.
