Hawley: Defendant State Farms Motion for Judgment on the Pleadings 65 is GRANTED and so Plaintiff Moores EEOC violation and state law wrongful termination claims are DISMISSED. State Farms Motion for Summary J udgment 67 is also GRANTED on Moores state law breach of contract claim based upon a violation of State Farms internal policies. The following claims as articulated in State Farms Motion for Summary Judgment remain: 1) an alleged Family Medical Leave Act violation; 2) retaliation based upon four instances of State Farm action; and 3) race discrimination based on three instances of State Farm action.
