IT IS THEREFORE ORDERED THAT:

The Report and Recommendation (#23) is accepted by this court.

The plaintiff’s Motion for Summary Judgment (#16) is GRANTED.

The defendant’s Motion for Summary Judgment (#22) is DENIED.

This case is remanded pursuant to sentence four of 42 U.S.C. §405(g). The clerk is
directed to enter judgment in favor of plaintiff John C. Mayer.

This case is terminated.
