OPINION entered by Judge Colleen R. Lawless on 9/26/2024. For all of these reasons, the Court concludes Plaintiff suffered no injury and thus lacks standing. This case will be dismissed for lack of subject matter jurisdiction. A determination that pl aintiff lacks standing means that the Court lacks jurisdiction. See Flynn, 39 F.4th at 954 ("When a district court concludes that the plaintiff lacks standing and thus that the court lacks jurisdiction-the judge may either dismiss without leave to amend or dismiss without prejudice.").Therefore, Defendant Ricola USA, Inc.'s Motion for Summary Judgment [Doc. 35 is GRANTED. This case is Dismissed for lack of subject matter jurisdiction and without leave to amend the complaint. The Clerk will enter judgment and terminate this case. See full written Opinion. (VH)
