STATEMENT
After ordering discovery on the issue of “unclean hands,” this Court referred all discovery disputes to
Magistrate Judge Denlow. Judge Denlow issued a Memorandum Opinion and Order on June 9, 2008 addressing
Grochocinski’s Motion for Protective Order that included both a primary ruling and an alternative ruling that
would come into effect if this Court refused to adopt the primary ruling. Grochocinski thereafter filed objections
to Judge Denlow’s Report and Recommendation.
On October 28, 2008, this Court entered an order rejecting Judge Denlow’s primary ruling, extending
discovery until January 31, 2009, and giving Defendants two weeks to file objections to Judge Denlow’s
alternative ruling. On November 12, 2008, Defendant’s filed their objections to the alternative ruling. On
January 30, 2009, this Court, in error, entered an order mirroring its October 31, 2008 order except extending
discovery until March 31, 2009. In response to this order, Defendants filed supplemental objections to the
alternative ruling on February 13, 2009. Grochocinski now moves this Court to strike Defendants’ supplemental
objections.
This Court has since corrected its docketing error by entering an order adopting the alternative ruling.
Because this Court did not intend to allow Defendants to file further objections to the alternative ruling, it grants
Grochocinski’s Motion to Strike Defendants Supplemental Objections to Judge Denlow’s alternative ruling.
Discovery remains open until March 31, 2009.
