STATEMENT Discovery conference convened. Motion to compel [61] is granted in part and denied in part: By agreement, Harris will produce all communications relating to possible infringement of the Harris patents, if those communications were created while Harris was at Fish & Richardson, other than communications that are subject to the attorney-client privilege. Fish & Richardson will thereafter identify which of the targets or potential targets are Fish clients. Harris will furnish the date on which his attorney/client relationship with the Niro firm began. In addition, Harris will provide unredacted agreements between Mr. Harris and his assignees. If review of those documents does not provide necessary information, Fish & Richardson will have leave to renew this motion. Mr. Harris's cross motion to compel [69] is granted in part and denied in part. Fish & Richardson agrees to disclose any communications from the firm's counsel to Mr. Harris himself. Plaintiff's motion for protective order [72] entered and continued for further response on 1/8/2008. Date for Plaintiff's response to Defendant's motion for judgment on the pleadings [29] extended to 1/3/2008.
