Defendants ) ) ) ) CIVIL ACTION NO.: 1: 11-cv-3054 ) ) ) ) ) ) PLAINTIFF’S MOTION FOR LEAVE TO FILE SUR-REPLIES AND SUMMARIES Plaintiff, Meanith Huon, states as follows: 1. The Above The Law Defendants were given leave to file a 22-page Memorandum of Law with Exhibits in Excess of 170 pages. The entire document is in excess of 192 pages. 2. The Jezebel Defendants were given leave to file a 27 page Memorandum of Law with 55 pages of exhibit. The entire document is 82 pages. 3. Mr. Huon was given leave to file a 22 page Response Brief to the Above The Law Defendants’ Motion to Dismiss and a 27 page Response Brief to the Jezebel Defendants’ Motion to Dismiss. 4. On November 30, 2011, Mr. Huon asked for a one week extension to file his Response Brief to the Jezebel Defendants’ Motion to Dismiss. 5. On December 5, 2011, the Court entered the following order, which now seems to essentially give all the Defendants 15 more pages to provide a Summary and reduced Mr. Huon’s 27 page Response brief to the Jezebel Defendants’ motion to 15 pages (since the Court didn’t specifically address his request for a one week extension of time but directed the parties to file their “Summary”): Plaintiff is granted leave to file a responsive brief of no more than 23 pages to the Above The Law Defendants Motion to Dismiss on or before December 12, 2011 2. As to all Memoranda relating to Above The Law Defendants Motion to Dismiss heretofore filed or scheduled to be filed, all parties shall file on or before December 12, 2011, a summary of no more than 15 pages of their respective Memoranda and a summary of no more than 15 pages of any exhibits to said Memoranda. (For further details, see Order in separate docket entry). The motion hearing set for 12/6/11 is stricken. Judicial staff mailed notice (gl, ) Mr. Huon could not have had time between November 30, 2011 and December 6, 2011 to to file a 27 page Response Brief and two 15 page Summaries. 6. On December 19, 2011, the Court granted all Defendants leave to file Replies and granted the Jezebel Defendants more time to file a Summary and a “Response”. The Court did not address Mr. Huon’s request to file his Summary Briefs. 7. The Above The Law Defendants will have been given an opportunity to file 192 page Memorandum and Exhibits, a 12 page Reply Brief and a Summary. Mr. Huon was limited to a 23 page Response Brief. 8 The Jezebel Defendants will have been given an opportunity to file an 82 page Memorandum and Exhibit, a Reply brief that could contain up to 15 pages, and a Summary that could contain up to 15 pages, and something called a “Response”. Mr. Huon was limited to a 15 page Response Brief. 9. It is unfair to limit the number of pages of Mr. Huon’s Response brief to 23 and 15 pages when the Defendants have filed voluminous pleadings, briefs, and/or summaries. Mr. Huon has or will suffer prejudice from the limitations placed on his briefs. 10. Defendants will not be prejudiced, since the status hearing date has been reset to January 26, 2012 at 10:30 a.m. WHEREFORE, Plaintiff, Meanith Huon, requests that this Honorable Court: 1. Grant him 28 days for leave to file a 27-page Sur-Reply Brief to all Defendants’ Memorandum and Replies. 2. Grant him 28 days for leave to file his 15-page Summaries.
