Accordingly, the Complaint is dismissed with prejudice pursuant to 28 U.S.C. Section 1915(e)(2)(B)(ii); and Plaintiff&# 039;s in forma pauperis application 4 is denied. Plaintiff's Motion for appointment of counsel 5 is therefore denied as moot. Plaintiff still remains obligated to pay the full filing fee of $350.
