BASTILLA, individually, and on behalf of all others similarly situated, Plaintiffs, NO. 3:10-cv-400-JPG-DGW vs. GOOGLE INC. Defendant. ORDER This matter comes before the Court on the parties' Joint Motion to Stay Pretrial Deadlines (Doc. 12) pending a decision of the United States Judicial Panel on Multidistrict Litigation ("the Panel") whether to coordinate the actions involving wrongs of the type at issue in this case ("Google Wi-Fi cases") for pretrial discovery and proceedings in MDL No. 2184 in the District of the District of Columbia pursuant to 28 U.S.C. § 1407(a). The Panel will hear arguments on this matter on July 29, 2010. 1. 2. The joint motion (Doc. 12) is GRANTED; This case shall be stayed pending the Panel's resolution of whether the Google Wi-Fi cases, and all subsequently filed similar actions, should be transferred to a single judicial district for coordinated or consolidated pretrial proceedings; 3. In the event that the Panel denies transfer of the Google Wi-Fi cases, and all subsequently-filed similar actions, to a single judicial district for coordinated or consolidated pretrial proceedings, Google shall have thirty days from the date of the order denying transfer to plead, answer, move, or otherwise respond to Plaintiffs' class action complaint; and Dockets.Justia.com 4. In the event that the Panel orders the coordination and transfer of the Google Wi-Fi cases, and all subsequently filed similar actions, to a single judicial district for coordinated or consolidated pretrial proceedings, Google shall plead, answer, move, or otherwise respond to Plaintiffs' class action complaint in accordance with the schedule set by the transferee court.
