MEMORANDUM AND ORDER
This matter comes before the court on the plaintiff’s Motion [Doc. 139] for Clarification.
The plaintiff is seeking clarification of this Court’s Memorandum and Order [Doc. 137] of July
11, 2017. The hereby GRANTS plaintiff’s motion and clarifies as follows:
(1)
Whether the plaintiff is permitted to attach exhibits to his amended complaint
and/or refer to exhibits previously attached.
Plaintiff may also attach exhibits, if such exhibits are necessary to the
allegations.
(2)
He further requests whether he may add additional facts and/or legal theories
to the counts set out by the Court.
As stated in the Memorandum and Order, the plaintiff is directed to add all
necessary facts and may, if appropriate, add a new legal theory to a count.
The Court will again advise the plaintiff that his amended complaint will be screened by
the Court to ensure compliance. If there are unnecessary exhibits, facts, or it appears that
plaintiff is attempting to add additional counts within the permitted counts, the Court will strike
those portions of the amended complaint. However, as long as the plaintiff makes a good faith
effort to comply, the Court will liberally construe the pleadings.

Plaintiff is once again CAUTIONED not to exceed one page per count, not to add any additional
defendants, and to set out the counts as indicated in this Court’s previous Order. Because of the
request for clarification, the Court will extend the period for the filing of the second amended
complaint. The plaintiff shall file his second amended complaint on or before August 28, 2017.
